Disclosing financial pressure in a disposal enquiry

If the business is under financial pressure, the auctioneer needs an accurate account of the concern relevant to the disposal. Avoid describing the enquiry as a straightforward retirement clearance if the ability to meet obligations is uncertain.
Seek qualified financial and insolvency advice promptly. For company directors, the Insolvency Service explains that duties and creditor priorities matter when a company becomes insolvent. An asset enquiry does not establish solvency or replace that advice.
State the concern as a fact to be assessed
Explain what is known, what remains uncertain and which professional is being approached or is already involved. Do not label the business solvent or insolvent from an equipment estimate.
A fictional enquiry statement might read:
We are considering closing the workshop and are concerned about meeting some upcoming obligations. We are seeking qualified advice on the financial position and the appropriate instruction route. I would like to understand what asset information would help assess the equipment-disposal question alongside that advice.
This gives the recipient relevant context without presenting an urgent sale as an approved solution. The financial uncertainty brief prepares the more detailed information for the qualified adviser.
Distinguish the money questions
An estimated asset value, a possible sale date and cleared money are different facts. Tell the adviser which parts of the closure plan depend on uncertain receipts and when obligations are expected to fall due.
The cash-timing record makes that mismatch visible. Keep disputed amounts and incomplete records marked rather than guessing a reassuring total.
Do not ask the auctioneer to decide which creditor should be paid, approve a personal retention or resolve a proposed connected-party transaction. Those questions need the relevant professional advice and authority.
Agree the scope of the next contact
When speaking to UK Auction Group, identify whether the immediate purpose is information gathering, an asset discussion requested by an adviser or another defined step. State any known limits on who can instruct the work.
Adviser involvement can show who is assessing the wider position. Arrange any professional contact or document sharing through the appropriate agreed route.
If the financial facts change after the first enquiry, notify the responsible adviser and relevant service provider promptly. Do not allow an earlier, more optimistic summary to continue guiding the disposal discussion.
The useful enquiry is direct about uncertainty and modest about what an equipment conversation can establish. It helps the right people obtain relevant facts without suggesting that a hoped-for sale receipt has already resolved the business's obligations.
